As we know, Scalia’s originalism was just a cover to let him justify whatever politically-based decisions he wanted to hand down.
But across-the-board, originalism is noting but a hoax anyway.
As Jay Michaelson writes at The Daily Beast, Gorsuch’s
“opinions would make the Founding Fathers turn over in their graves.
The Supreme Court nominee’s record on cases pitting individual against corporate rights tilts consistently in favor of corporations over many years. And while many conservative ‘originalists’ don’t like to talk about it, the Founders hated corporations and sharply limited their power.”
